Divorce
A divorce case involves the legal process by which a marriage is legally dissolved. In India, divorce can be granted through a mutual divorce or through a contested divorce.
Contested divorce typically begins when one spouse files a petition for divorce, citing grounds such as Adultery, Cruelty, Desertion, Conversion, Unsound mind, when one of the spouse has renounced the world, Leprosy, Venereal Disease, Bigamy, Rape, sodomy, domestic violence. The Petitioner, submits a formal request to the court, outlining the reasons for the divorce and any requests for asset division, alimony, child custody, or support.
If the parties cannot agree, the case may proceed to trial, where a judge will make final decisions on the division of property, financial support, alimony and child custody arrangements. The aim is to reach a fair and equitable resolution, prioritizing the well-being of children if any and ensuring that both parties' legal rights are upheld. Once resolved, the court issues a final decree of divorce, legally ending the marriage.
